DigiBooBoo is a connected wound-monitoring system developed to support clinicians, researchers, care teams, and authorized partners. This document outlines the terms, policies, and obligations governing your use of Digi Med Dev’s website, services, programs, and the DigiBooBoo Platform. By interacting with Digi Med Dev or accessing any part of DigiBooBoo, you acknowledge and agree to the provisions set forth herein.

  1. Information we collect

    We collect information that is necessary to operate our platform, communicate with users, improve our services, and support pilot programs and product evaluations. This may include:

  4. Do not track signals

    At this time, Digi Med Dev does not respond to “Do Not Track” (DNT) browser settings because no unified industry standard exists. We will update this policy if applicable standards are established.

Terms of Use

DigiBooBoo Website and Platform Terms of Use

Effective Date: January 10, 2026

  1. Agreement to terms

    These Terms & Conditions (“Terms”) govern your access to and use of the Digi Med Dev website, early access program, and associated services. By accessing our website or participating in any Digi Med Dev programs, you agree to these Terms and our Privacy Policy. If you do not agree, you should discontinue use of our website and services.

  2. Intellectual property

    All content, trademarks, logos, graphics, and materials on the Digi Med Dev site are the property of the Company or its licensors. Users may not reproduce, distribute, modify, or republish any content without express written permission.

  3. User responsibilities

    By using our site or participating in early access programs, you represent and warrant that:

    • You are at least the age of majority in your jurisdiction
    • Information you provide is accurate and complete
    • You will not use the site for unlawful, harmful, or disruptive activities
    • You will not use automated tools, bots, or unauthorized scripts to access the site
    • You will not impersonate another individual or misrepresent your identity

  6. Prohibited activities

    • Engage in unlawful, harmful, or fraudulent activity
    • Upload or transmit harmful content, malware, or disruptive scripts
    • Attempt to gain unauthorized access to systems, databases, or other accounts

    Violations may result in suspension or legal action.

    These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration unless otherwise required by law.

  12. Dispute resolution

  13. Indemnification

    Users agree to indemnify and hold Digi Med Dev harmless from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from violations of these Terms or misuse of the site and services.

    We maintain reasonable safeguards to protect user data but cannot guarantee absolute security. Users acknowledge that transmission of information over the internet carries inherent risks.

End User License Agreement

DigiBooBoo End User License Agreement (EULA)

Effective Date: January 10, 2026

This End User License Agreement (“Agreement,” “EULA”) is a legal agreement between you (“User,” “you,” or “your”) and Digi Med Dev Inc. (“Digi Med Dev,” “we,” “our,” or “the Company”) regarding your access to and use of the DigiBooBoo platform, devices, software, firmware, applications, and related services (“DigiBooBoo,” “the Platform,” or “the Product”).

By accessing or using DigiBooBoo, you acknowledge that you have read, understood, and agree to be bound by this EULA.

If you do not agree to these terms, you must not use DigiBooBoo.

  1. License grant

    Digi Med Dev grants you a limited, revocable, non-exclusive, non-transferable license to:

    • Access and use the DigiBooBoo Platform
    • Use DigiBooBoo devices provided to you
    • Access dashboards, mobile apps, or desktop tools associated with the Platform
    • Use DigiBooBoo solely for clinical evaluation, pilot testing, research, training, or authorized internal use

  2. Restrictions

    You agree not to:

    • Modify, decompile, reverse engineer, or attempt to extract source code
    • Copy, distribute, or reproduce DigiBooBoo software or firmware
    • Install unauthorized software on DigiBooBoo devices
    • Use DigiBooBoo for any unlawful purpose
    • Circumvent security features
    • Rent, lease, sublicense, or transfer access to any third party
    • Interfere with or disrupt Digi Med Dev systems, devices, or services

    Use of the Platform outside scope of approved clinical pilots or internal evaluation requires a separate written agreement.

  3. Ownership and intellectual property

    DigiBooBoo—including all hardware designs, firmware, algorithms, software, dashboards, UI/UX assets, brands, trademarks, and documentation—is the exclusive property of Digi Med Dev Inc.

    No rights or licenses are granted except those explicitly provided in this EULA.

  4. Clinical use and limitations

    DigiBooBoo is not an FDA-cleared medical device and is provided for:

    • Pilot testing
    • Evaluation
    • Research
    • Prototyping
    • Workflow exploration

    DigiBooBoo must not be used as the sole basis for diagnosis, treatment decisions, or critical clinical interventions.

    All clinical decisions remain fully under the responsibility of qualified medical professionals.

  5. Data handling and privacy

    Digi Med Dev:

    • Receives no PHI or PII
    • Receives only non-identifiable device telemetry and sensor data
    • Stores and processes data securely in accordance with applicable laws
    • Uses de-identified data for R&D, reliability analysis, and platform improvement

    You agree not to upload, transmit, or associate PHI or identifiable patient data with DigiBooBoo or Digi Med Dev systems.

    Any inadvertent transmission of PHI must be reported immediately to legal@digibooboo.com.

  6. User responsibilities

    You agree to:

    • Use DigiBooBoo devices responsibly and follow provided instructions
    • Maintain secure access to accounts, credentials, and user devices
    • Report issues promptly to Digi Med Dev
    • Ensure that use of DigiBooBoo complies with local laws, clinical policies, and ethical standards

    Users are responsible for maintaining confidentiality of login information.

  7. Device handling

    If DigiBooBoo devices are issued to you:

    • Devices remain property of Digi Med Dev
    • You must use them safely and store them securely
    • Loss or damage may incur replacement costs
    • Devices must be returned upon request or at end of evaluation
    • Device serial numbers must not be altered or tampered with

    A separate Device Loan Agreement governs physical device obligations.

  8. Disclaimers

    DigiBooBoo is provided "AS IS" and "AS AVAILABLE," with:

    • No warranties of performance
    • No warranties of accuracy
    • No implied warranties of merchantability or fitness for a particular purpose

    Digi Med Dev does not warrant that DigiBooBoo will meet all clinical requirements or operate without interruption.

  9. Limitation of liability

    To the maximum extent permitted by law:

    • Digi Med Dev is not liable for indirect, incidental, consequential, or punitive damages
    • Digi Med Dev is not liable for clinical decisions, outcomes, or medical consequences
    • Digi Med Dev’s total liability is limited to fees paid (if any) for use of DigiBooBoo

    This limitation survives termination.

  10. Termination

    Digi Med Dev may suspend or terminate this EULA if:

    • You violate the Agreement
    • You misuse the Platform or devices
    • You attempt unauthorized modifications
    • You engage in harmful behavior toward Digi Med Dev systems or staff

    Upon termination:

    • You must discontinue use
    • Devices must be returned
    • Accounts may be disabled
    • Access to stored data may be revoked

  11. Governing law

    This Agreement is governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
